We won a big victory this morning. Last month we asked a judge to block Electron Hydro from opening the water intake to generate electricity, and profits, as it tries to salvage its fish-killing Electron Dam.
We argued that opening the intake would kill more fish, and we asked the judge to issue a preliminary injunction to keep the dam owners from opening that intake until they get the right permits. In his ruling, the judge cited much of the evidence given by our Fisheries experts, who spent hours detailing impacts to fish and our Membership.
The Court determined the order closing the intake was warranted due to the Tribe’s substantial interest in protecting fish and the Tribe’s high likelihood of success on the issues in the entire case. A bench trial is scheduled for April 2022.
We are grateful the court agreed that the evidence was clear. The dam kills fish, and opening that intake would kill more fish.
Electron Hydro dumped artificial turf into the river and has shown no respect for the fish or clean water. Ultimately, Electron Dam and its outdated, fish-killing legacy should go.
This ruling is a major win. The fish can’t speak for themselves. We have to do it for them. We are fighting for them and for you.
